- Introduction and Agreement to Terms
- 1.1. Acceptance of Agreement: These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and SpeechUnite HK Limited, a company incorporated in Hong Kong with its registered office at 2406B, 24/F, Low Block, Grand Millennium Plaza, 181 Queen’s Road Central, Sheung Wan, Hong Kong (“Company”, “we”, “us”, “our”). This agreement governs your access to and use of the SpeechUnite HK application, including any content, functionality, and services offered therein (collectively, the “Service”). By downloading, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not access or use the Service.
- 1.2. Parties to the Agreement: For the purposes of these Terms, a “User” is the individual whose speech is being trained or treated. If the User is a minor or lacks the legal capacity to enter into a binding contract (for instance, due to cognitive impairment), the term “User”, “you”, and “your” shall also include the parent, legal guardian, or authorised caregiver who accepts these Terms on the User’s behalf.
- 1.3. Warranty by Guardian or Caregiver: If you are accepting these Terms on behalf of another person (the “End-User”), you hereby represent and warrant that you are the parent, legal guardian, or a duly authorised caregiver of the End-User and that you have the full legal authority to bind the End-User to this agreement. You agree to be fully responsible for the End-User’s compliance with these Terms.
- 1.4. Modification of Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least thirty (30) days’ notice of any material changes, either through an in-app notification or by email to the address associated with your account. Your continued use of the Service after such modifications become effective constitutes your acceptance of the new Terms.

- 2.1. NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE: THE SERVICE, INCLUDING ALL EXERCISES, TRAINING MATERIALS, AND FEEDBACK, IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT IS NOT, AND IS NOT INTENDED TO BE, A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT FROM A QUALIFIED SPEECH-LANGUAGE PATHOLOGIST, MEDICAL DOCTOR, OR OTHER REGISTERED HEALTHCARE PROVIDER.
- 2.2. CONSULT A HEALTHCARE PROFESSIONAL: YOU ARE STRONGLY ENCOURAGED TO CONSULT WITH A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE BEGINNING TO USE THE SERVICE, AND REGULARLY THEREAFTER, TO DETERMINE IF IT IS SUITABLE FOR YOUR NEEDS. DO NOT DISREGARD, AVOID, OR DELAY OBTAINING MEDICAL ADVICE FROM A QUALIFIED PROFESSIONAL BECAUSE OF SOMETHING YOU MAY HAVE READ OR INTERPRETED FROM THE SERVICE.
- 2.3. NO GUARANTEE OF OUTCOME: THE EFFECTIVENESS OF SPEECH THERAPY IS HIGHLY INDIVIDUAL. WE MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE. YOUR PROGRESS AND OUTCOMES ARE DEPENDENT ON NUMEROUS FACTORS BEYOND OUR CONTROL.
- 2.4. NOT FOR MEDICAL EMERGENCIES: THE SERVICE IS NOT DESIGNED FOR USE IN MEDICAL EMERGENCIES. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 999 IMMEDIATELY OR CONTACT YOUR DOCTOR.
- User Accounts
- 3.1. Eligibility and Registration: To use the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.
- 3.2. Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately of any unauthorised use of your account.
- 3.3. Responsibility for Account Activity: The individual or entity who created the account is fully responsible for all activities that occur under that account, regardless of whether such activities are undertaken by them or a third party.
- Description of Service and Licence
- 4.1. The Service: The Service provides users with access to a collection of speech therapy exercises, progress tracking tools, and educational content.
- 4.2. Limited Licence: We grant you a personal, non-transferable, non-exclusive, revocable licence to download, install, and use the Service for your personal, non-commercial use, subject to your compliance with these Terms.
- 4.3. Service Availability and Modification: We reserve the right to withdraw, modify, suspend, or discontinue any aspect of the Service at any time without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
- Financial Terms
- 5.1. Subscriptions: The Service may be offered on a subscription basis. By selecting a subscription plan, you agree to pay the applicable fees as presented to you.
- 5.2. Payment and Billing: Subscription fees are billed in advance on a recurring basis (“Billing Cycle”). Your subscription will automatically renew at the end of each Billing Cycle unless you cancel it through your account management page or by contacting us. You authorise us (or our third-party payment processor) to charge your chosen payment method for the recurring fees.
- 5.3. Free Trials: We may offer a free trial for a limited period. If you do not cancel before the end of the trial period, you will be automatically charged the subscription fee for the plan you selected.
- 5.4. Refund Policy: Except when required by law, all fees paid are non-refundable. Any refunds shall be at our sole discretion and only in the form of credit for the Service.
- 5.5. Price Changes: We may change the subscription fees at any time. We will provide you with reasonable prior notice of any price changes to give you an opportunity to cancel your subscription before the change becomes effective.
- Privacy and Data
- 6.1. Privacy Policy: Your privacy is of utmost importance to us. All personal data you provide to us, including sensitive data such as voice recordings and health information, is collected, stored, and processed in accordance with our Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486) of the laws of Hong Kong. - 6.2. Anonymised Data for Service Improvement: You agree that we may collect, use, and share anonymised and aggregated data derived from your use of the Service. This data will be stripped of all personal identifiers and will be used for internal purposes, such as analysing usage patterns, improving our algorithms, conducting research, and enhancing the Service.
- Prohibited Conduct
You agree not to:
- (a) Reverse-engineer, decompile, or otherwise attempt to discover the source code of the Service.
- (b) Use the Service for any illegal or unauthorised purpose.
- (c) Infringe upon our intellectual property rights or the intellectual property rights of others.
- (d) Transmit any worms, viruses, or any code of a destructive nature.
- (e) Attempt to gain unauthorised access to our systems or disrupt the integrity of the Service.
- Intellectual Property Rights
- 8.1. Ownership: The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by Hong Kong and international copyright, trademark, patent, and other intellectual property laws.
- 8.2. User Feedback: If you provide us with any ideas, feedback, or suggestions regarding the Service (“Feedback”), you hereby assign to us all rights in the Feedback and agree that we shall have the right to use such Feedback in any manner we deem appropriate without any compensation or attribution to you.
- Termination of Use
- 9.1. Termination by Us: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
- 9.2. Termination by You: You may terminate your account at any time by following the instructions within the app or by contacting our support team.
- 9.3. Effect of Termination: Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
- Limitation of Liability and Indemnity
- 10.1. Disclaimer of Warranties: TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- 10.2. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT OF FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM ARISING, OR (B) ONE THOUSAND HONG KONG DOLLARS (HK$1,000). NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE OUR LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY THE LAWS OF HONG KONG.
- 10.3. Indemnification: You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
- Dispute Resolution
- 11.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR), without regard to its conflict of law provisions.
- 11.2. Informal Resolution: We encourage you to contact us at speechunitehk@gmail.com to seek a resolution for any dispute or concern before resorting to formal legal action.
- 11.3. Binding Arbitration: Any dispute, controversy, difference, or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach, or termination thereof, shall be referred to and finally resolved by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.
- 11.4. Class Action Waiver: You agree that any claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- Miscellaneous Provisions
- 12.1. Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and the Company regarding our Service and supersede all prior agreements.
- 12.2. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
- 12.3. Language: These Terms are prepared in the English language. If they are translated into any other language, the English language version shall prevail in the event of any conflict or inconsistency.
- 12.4. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

SpeechUnite HK Limited (“Company”, “we”, “us”, “our”) is committed to protecting the privacy and security of your personal data. This Privacy Policy explains how we collect, use, store, share, and protect your information when you use the SpeechUnite HK application and its related services (collectively, the “Service”).
This policy is prepared in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of the laws of the Hong Kong Special Administrative Region (“PDPO”). By using the Service, you consent to the data practices described in this policy. This Privacy Policy is incorporated into and forms part of our Terms and Conditions.
For the purpose of this policy, “Personal Data” means any data relating directly or indirectly to a living individual from which it is practicable for the identity of the individual to be directly or indirectly ascertained.

We collect information that is necessary to provide and improve the Service. This information is collected in the following ways:

- Account Registration Data: If you wish to establish an account you will be required to provide us with information (personally identifiable information and non-personally identifiable information).
- User Profile Information: You may choose to provide information for your therapeutic needs, such as your age, gender, role in therapy,, and other related health information. Providing this is optional but may be required for certain features.
- Communications: If you contact us for support or feedback, we will collect a record of that correspondence, including your email address and the content of your communication.
- B. Information We Collect Automatically During Your Use of the Service:
- Usage and Performance Data: We automatically collect data about your interaction with the Service, such as the exercises you complete, your performance scores, progress over time, features used, and the frequency and duration of your sessions.
- Device and Technical Data: We collect technical information about the device you use to access the Service, including your IP address, device type, operating system version, unique device identifiers, and app version.
- C. Information from Third Parties:
- Payment Information: If you subscribe to a paid version of our Service, payments are processed by a secure third-party payment processor (e.g., Stripe, Apple App Store, Google Play Store). We do not collect or store your full credit card or financial account information ourselves. We only receive transaction confirmations and billing details.

We only use your Personal Data for the purposes for which it was collected, as outlined below:
- To Provide, Maintain, and Operate the Service: To create and manage your account, deliver the therapy exercises, and track your progress.

- To Communicate With You: To send you important service-related announcements (e.g., updates to our Terms or this Policy), respond to your support requests, and provide information about your account.
- For Security and Legal Compliance: To protect the security and integrity of our Service, to prevent fraud and abuse, to enforce our Terms and Conditions, and to comply with our legal obligations under Hong Kong law.
- For Billing and Account Management: To process your subscription payments and manage your account.

- Contractual Necessity: To perform our contract with you, as outlined in our Terms and Conditions (i.e., to provide you with the core functionality of the Service).

Our Service is global, and your data may be stored and processed on servers located outside of Hong Kong, where our third-party service providers have facilities. We will take all steps reasonably necessary to ensure that your data is treated securely and that any transfer of data is protected by appropriate safeguards, ensuring a standard of protection comparable to that provided under the PDPO.
- Children’s Privacy
The Service is not intended for use by individuals under the age of 13 without the express consent and involvement of a parent or legal guardian. If you are a parent or guardian and you become aware that your child has provided us with Personal Data without your consent, please contact us. If we become aware that we have collected Personal Data from a child without verification of parental consent, we will take steps to remove that information from our servers.
